The Sheriffs of Zambia have obtained a writ of fieri facias from the High Court to grab Pambashe Member of Parliament, Ronald Chitotela’s goods and chattels to recover over K5 million debt.
This is for the debt owed to the construction company Azadi Investment Limited, which built his residential house in Chongwe.
According to a stamped writ of Fi fa before the Economic and Financial Crimes Court dated April 19, 2024, Chitotela, a former Minister in the previous Patrotic Front government, owed Azadi Investment Limited K5,960,000, being the balance of the principal amount owed to the company.
“You are hereby commanded that the goods and chattels of Ronald Kaoma Chitotela be ceased be made in recovery of the sum of K5,960,000, being the balance of the principal amount owed to the plaintiff and also interest at the short term Bank of Zambia rate being 9.5 percent,” read the Fi fa in part.
Background to the case is that Azadi Investment Limited, in May, 2022, approached Lusaka High Court, demanding payment of K6.5 million, being the balance for the construction of his house worth over K9.6 million in Chongwe.
The company is demanding an order for payment of K6.5 million and the corresponding Value Added Tax owed to it as interest, and an alternative order for the sale of the said property, CHONG/LN_21188/51.
The company submitted to Court that on August 6 of 2018, it entered into a construction agreement with Chitotela for the construction of a residential house in Chongwe at a cost of K9,650,000.
Azadi Investment said the former Minister only paid K3,150, 000.00 and that the balance of K6,500,000 and the corresponding VAT remained unpaid to the date of filing of the statement of claim.
Chitotela in his defence admitted owing Azadi Investment the said amount.
In a ruling of January 9, 2023, the court ordered that Chitotela pay Azadi Investment the said amount with interest.
Chitotela contested the ruling and demanded for a review of the judgement debt, but his application was dismissed.
